BIG WIN for Injured Workers; HB 4138

Thanks to the hard work of the Oregon Trial Lawyers Association and some truly outstanding State legislators, Oregon House Bill 4138 has gone to the Governor for her signature. This bill addressed some big gaps in the WC system. Most notably, it will require carriers to give a written explanation to a worker before suspending that worker's lost wage payments, and it limits the amount of "overpayment" an insurance company can claim by back-dating when that worker was declared "medically stationary."

Once signed into law, it will go into effect in 2023. This is really an amazing accomplishment
